Beaumont Business Files Lawsuit About Hurricane Ike Insurance Claim

A business located in Beaumont, Texas, has filed a lawsuit against its insurance company. The lawsuit states that the insurance company failed to fairly compensate the business for a property damage claim. The business’ property was damaged during Hurricane Ike in 2008.

According to The Southeast Texas Record, the region’s legal journal, Greentree Village Investments Ltd. filed an insurance claim with Texas Windstorm Insurance Association in September 2008. The claim stated that the business’ property, located on Dowlen Road in Beaumont, was damaged on September 18, 2008, by the affects of Hurricane Ike. The civil lawsuit was filed in Jefferson County and seeks actual damages, additional damages, and court costs.

Greentree Village Investments Ltd. claims that it made a timely, complete, and valid insurance claim in the wake of the storm and its property damage. However, it was not compensated for the damage by its insurance company as agreed in the coverage policy. Specifically, the insurance company is being sued because of:

  • Breach of contract
  • Breach of fiduciary duty
  • Violations of the Texas Insurance Code

Hurricane Ike was the third most costly storm to strike the United States in recorded history. The eye of the storm passed through Texas in mid-September 2008, causing widespread property damage along with dozens of fatalities. The Galveston-Houston area was hit particularly hard, as was Beaumont, which is located just east of Houston along the Gulf Coast.
